The Annual Meeting of Landowners and Supervisors of the Central Charlotte County Drainage District was held on Thursday, May 28, 2026. The meeting was held at the Charlotte County Public Works building conference room, 7000 Florida Street, Punta Gorda, Florida 33950.
The meeting was called to order at 2:00 p.m. Roll was taken and it was determined that all Supervisors were present. Landowners were also present at the meeting. Attached to these minutes is a roll reflecting the landowners who were physically present at the meeting. All of the Supervisors were present as follows: Vincent Boccio, Carol Nevling, and Ray Whiteman. Also present at the meeting were the District’s Secretary/Treasurer, Ms. Judy Uhland, the District’s attorney, Edward L. Wotitzky, and Robin Palmer, P.E. Project Engineer with Apex Companies, LLC.
Due and proper Notice of the meeting was established. Attached to these minutes is the Publisher’s Affidavit of Publication confirming the Notice of Meeting was published in the Daily Sun newspaper on May 7 and May 14, 2026.
The minutes of last year’s annual meeting of landowners and supervisors which was held on June 20, 2025, were then considered. On motion duly made, seconded and unanimously carried, the minutes were approved as submitted.
Landowners then proceeded to elect one supervisor for the position currently held by Carol Nevling. Ms. Nevling’s term will expire on September 30, 2026. Carol Nevling was nominated to serve an additional three (3) year term commencing April 1, 2026. There were no other nominations, and on motion duly made, seconded and unanimously carried, Carol Nevling was elected to serve as a Supervisor of the District for another three (3) year term commencing on October 1, 2026.
As a result result of the election, the following individuals constitute the Supervisors of the District for the noted terms:

The Supervisors then proceeded to elect officers for fiscal year commencing October 1, 2026. On motion duly made, seconded and unanimously carried, the following individuals were elected to the noted offices:

Vice President: Carol M. Nevling
Secretary /Treasurer: Judy Uhland
The financial report of the District submitted to the Chief Financial Officer of the State of Florida was then reviewed. The financial report is a report for fiscal year ending September 30, 2025. The said report is attached to these minutes.
In addition to the financial report, financial statements which had been provided to the Supervisors including a Bank of America statement for the Association’s account for period ending April 30, 2026, a checking account detail and reconciliation, a balance sheet, and a profit and loss statement were also presented and reviewed by Judy Uhland. A copy of the statement and financial statements are also attached to these minutes.
The proposed budget for fiscal year commencing October l, 2026 was then reviewed. A copy of the proposed budget is attached to these minutes. Ms. Uhland reviewed the proposed budget. The budget contemplates the levy of the maximum assessment of $50 per acre. After further discussion, and on motion duly made, seconded and unanimously carried it was:
RESOLVED, that the proposed budget, a copy of which is attached to these minutes, for fiscal year commencing October 1, 2026 is approved and adopted. It was further
RESOLVED, that assessments shall be levied at the rate of $50 per acre for fiscal year beginning October 1, 2026, and the assessment roll was approved.
The attorney for the District then noted the establishment of goals for the upcoming fiscal year will include the assessment of the existing water control plan for the District. In these regards, he noted the requirements set forth in Chapter 298 of the Florida Statutes concerning the adoption and review of water control plans. Mr. Wotitzky introduced Robin Palmer, an engineer with Apex Companies, formerly Weiler Engineeing Corporation to review her proposal to provide engineering services to evaluate and possibly update the existing water control plan. Attached to these minutes is a format of a proposal provided to the District under cover of letter dated March 17, 2026.
Ms. Palmer made a presentation concerning the proposal and the varying scope of services which could be provided in connection with evaluating the current plan and existing drainage in the District.
The Supervisors provided additional comments concerning matters of concern with respect to the maintenance of the various ditches in the District and areas of concern. One area of concern involved erosion in one of the ditches which has been cleaned and which has been herbicided. Ms. Palmer noted that there were a number of different ways to harden the ditch sides which could be considered in connection with amending or modifying the water control plan. Ms. Nevling noted some of the ditches which are located within the boundaries of the Central Charlotte County Drainage District are actually being maintained by either the Airport Authority or the County. In connection with those ditches, the attorney mentioned same should be identified and, if possible, an interlocal agreement of agreements should be entered with the agencies or entities providing services associated with maintaining the said ditches.
The Supervisors noted to Ms. Palmer the extent funding which may be available for the purpose of initiating the evaluation and update of the water control plan. After discussion, it was noted that initial services involving field and site visits and an evaluation of current conditions would be the priority. Ms. Palmer indicated she would provided a proposal outlining services to be rendered in these regards together with costs and fees which would be associated with same. Ms. Palmer also indicated that grant funding from the Southwest Florida Water Management District may be available for the purpose of funding engineering services and work required to update the water control plan and provide additional work concerning the ditches.
the existence of the ditches and roads in the area of the Central Charlotte County Drainage District were not established by recorded easements, dedications, or by eminent domain. The District has, however, taken the position, along with the County, that precriptive rights have been established with respect to the location and maint~nance of ditches and canals. He did note, however, a judicial determination concerning the exact location and scope of the prescriptive easements may need to be established.
The Supervisors then determined that at such time as a revised proposal for engineering services is provided, a workshop meeting should be scheduled for the purpose of considering the said proposal, and possibly engaging the engineer. Ms. Nevling noted the time for performing the site work should be during the rainy season to enable the engineer to better evaluate the current drainage facilities and functions.
There being no further business before the landowners and supervisors, the meeting was, on motion duly made, seconded, and unanimously carried, adjourned.
